Orange County Probate Court: Where Your Case Is Heard and What Selling Costs

What the Court Actually Charges
Orange County publishes a civil fee schedule, and the probate items on it are statewide amounts rather than local inventions:

Note the sixth line. If the personal representative holds only limited authority, the petition to confirm the sale of the house is its own $435 filing on top of the one that opened the case. Publication in an Orange County newspaper of general circulation is a separate cost paid to the publisher, not to the court.
The Probate Referee Sets the Number, Not You
When the court appoints a personal representative it also designates a probate referee from the panel appointed by the California State Controller. The referee, not the family and not a listing agent, appraises the real property for the estate inventory. The commission is one-tenth of one percent of appraised value, with a floor of $75 and a ceiling of $10,000, and the referee is expected to return the appraisal within roughly 60 days.
That appraised figure matters to a seller because the court measures any later sale price against it. The inventory and appraisal, Judicial Council forms DE-160 and DE-161, are due within four months of appointment.
Probate Notes: Orange County’s Early Warning System
This is the single most useful local feature and the one most out-of-county filers miss. Examiners review each petition before the hearing and post written notes listing every defect, typically three to four weeks ahead. They are searchable through the court’s probate notes portal, and the court will send a text message when notes post on your case.
Clear the notes and the hearing is usually short. Leave them uncleared and the judge continues the matter, which in practice costs weeks, not days — and if a buyer is waiting on letters, those weeks are the whole delay. Selling the House: Full Authority Versus Limited
Under the Independent Administration of Estates Act, a representative with full authority can sell real property after mailing a Notice of Proposed Action, form DE-165, to everyone entitled to notice at least 15 days before acting. A detail that trips people up: someone other than the representative has to do the actual mailing.
With limited authority, the sale goes to a confirmation hearing, and the courtroom overbid process means an accepted offer is not final until the judge says so. Other deadlines that shape the timeline: 30 days to allow or reject a creditor’s claim, and up to 90 days to notify the Department of Health Care Services about possible Medi-Cal recovery.
