1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern your use of the website located at cashhomebuyersca.com (the “Site”), operated by Prestige Enterprise Consulting Group LLC, doing business as Cash Home Buyers CA (“Company,” “we,” “us,” or “our”). By accessing or using the Site, or by submitting information through any form on the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

The Company provides information about, and connects property owners with, options for selling real property for cash and, where appropriate, connects property owners with independent, licensed real estate agents for traditional listing services. The Company operates nationwide across the United States. Nothing on the Site constitutes a binding offer to purchase any property. Any cash offer is preliminary and non-binding until the parties execute a written purchase agreement.

3. No Brokerage Relationship; Licensing

The Company is a direct property buyer and referral service, not a licensed real estate brokerage, unless expressly stated otherwise in a separate signed agreement. Where the Company refers you to a licensed real estate agent, that agent acts independently, and the Company is not a party to, and assumes no liability for, the agent’s services, representations, or any resulting brokerage agreement.

4. Eligibility and Property Information

By submitting a property or contact information through the Site, you represent that you are at least 18 years old, that the information you provide is accurate, and that you are the owner of the property or are otherwise authorized to submit it for evaluation.

5. Consent to Be Contacted (Calls, Texts, and Email)

By submitting your phone number or email address through the Site, you expressly consent to be contacted by the Company and its representatives by telephone (including calls using an automatic telephone dialing system or an artificial or prerecorded voice), SMS or text message, and email, at the number or address provided, regarding your inquiry and related offers. Consent is not a condition of any purchase. Message and data rates may apply, and message frequency may vary. You may revoke consent to text messages at any time by replying STOP, and may opt out of emails using the unsubscribe link in any email. Standard federal law, including the Telephone Consumer Protection Act (TCPA) and the CAN-SPAM Act, governs these communications, and we intend to comply with both.

6. Cash Offers Are Non-Binding

Any cash offer, estimate, or valuation provided through the Site or by a representative of the Company is preliminary, non-binding, and subject to change based on further inspection, title review, and market conditions. No obligation to sell or buy arises until both parties sign a formal, written purchase agreement.

13. Dispute Resolution; Arbitration Agreement; Class Action Waiver

You and the Company each waive any right to a jury trial and to participate in a class, collective, or representative action. This arbitration agreement survives termination of these Terms.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where federal law (including the TCPA, CAN-SPAM Act, and Federal Arbitration Act) applies.

15. Force Majeure

The Company is not liable for any delay or failure to perform resulting from causes beyond its reasonable control, including acts of God, natural disaster, war, labor disputes, or failures of third-party systems.

16. Severability; Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms constitute the entire agreement between you and the Company regarding the Site and supersede any prior agreements.
